How come women have no rights concerning there own children if divorced in an Islamic country?

Is this to keep them chained to abusive husbands?

Because women have no rights, period. They are considered property.

There have been many ignorant answers preceding mine.

First, in Islam, the father has the responsibility toward feeding and caring for the child, but he also has to give the mother reasonable rights to spend time with her child, as I understand it, so what you say is a bit false.

Second, I worked in child care for many years, and my observation is that children raised by single fathers do better emotionally, socially, behaviorally, and academically than their peers raised by single mothers. (I've read scientific articles which support my observation.) Additionally, children raised by single fathers tend to see their mothers more than children raised by single mothers see thier fathers. Perhaps even before the prevalence of divorce, Islam set things this way because God knows human nature, and knows that in most cases this is the best upbringing for the children.

Of course, if the father is bad, for example is abusive or an unbeliever, he would not have rights over the children, Islamically.

(I am talking about Islam as I understand it here, not culture.)

This really bewilders me how people try to learn about Islam with an intention to seek faults in it. You didn't see the rights of women in Islam, and you saw what happens to divorced wife? And then you reached a judgment "women have no rights in Islam' that make you ask this question and inviting people to understand how bad Islam is! Wow!

Firts of all, divorce is the least agreeable thing to permit in Islam. It can only be done under specific circumstances.

I believe Muslim women definitely have rights to the children after divorce.

  • Thank you for this question.

In actual Islamic law based on Quran, Hadith and usul al fiqh, the usual rule is that children stay with the mother until they reach an age where they can decide and the father is still responsible for them during this period.

Rules in supposedly Islamic contries have been modified according to cultural biases and according to those who like to keep power. Allah will deal with them in the end for their misdeeds. In the meantime we must be vigilant and overturn these laws when we see them. For instance the rape law in Pakistan is undergoing change right now and we hope that there will be more cases like this in the future.

Unfortunately there is no country in the world at the moment that actually practices Islamic law that way it was intended. My opinion is that the US actually has laws that are closes to Islamic law in cases of social justice and some business law but there are still big differences.

    And Allah knows best.

    Peace and Blessings,

    Salim

Not all "Islamic nations" have no rights for women. Jordan, Syria, even Iran have provisions for women's protection. My suggestion would be to turn off the t.v. and go visit these countries. Find out for yourself what is going on before making "blanket judgments". In the countries that do not provide protection and equal rights for women you are dealing with history and long to segregation from world society. Society evolves and changes from year to year. Being cut off from it causes stagnation.

Women don't have too many rights concerning their children in this country either.Ever since the father's rights b*llshit. And it is .Like to see one of them give birth, and they want to take children away from their mothers. Shame on all of them.

Because they are subject to Islamic Law. Most Islamic countries are not democracies or republics. Religious law is the law...
