Is it illegal to give a cigarette to a minor?

My neighbor buys her 16 year old son cigarettes. He chain smokes them all day long. He goes to special* school so he's home all day. I know that he can't buy them - that's illegal. Is it illegal for his mother or another adult to give them to him? Is it illegal for him to smoke them?

*Does not go to school. Has a "nervous condition" which is why his mother allows the smoking. His teeth are the color of Kahlua. =)

    By law minors can't buy cancer sticks, but no laws forbid a legal guardian from indulging them in that way, unlike the fact that they might get into hot water for letting them drink.

    Providing alcohol to a minor is a criminal offence, and I don't think there are allowances for guardians anywhere there are such laws. Providing tobacco is not, though somebody who is not a guardian could get nailed on generalist controlled substance laws. Of course, letting an 8 year old smoke could get you in hot water with child support services, but a 16 yo... unlikely, unless there are additional medical or psychiatric issues involved.

    It is illegal ,but sometimes the parents that smoke leave the cigarrets box around in the house and dont see when they take some of them I think that they follow our examples.

    Yes I would think this would be illegal. What kind of parent gives their kids cigarettes to her child. She might as well say go ahead get lung cancer.

    Yes, but it's hard to prove that it happened. She and the boy could just say the boy bought them or got them elsewhere.
