Who gets the money upon death??

My MIL and FIL have moved in with my FIL mother. My in laws have totally redone the entire house because it was not good enough for them. They made a three bedroom into a two bedroom so they could have a bedroom that was huge. My MIL has totally redecorated(not tastefully either) the enitre house. There is nothing but the living room set left that was there before. SO, the other day my MIL says she is keeping all the reciepts so that when Gram dies, she can get her money back. Are you kidding me? Can she legally do this, make the other family members repay her for the updates out of their inheritance when they sell the house? They're pieces of work let me tell you. But legally, do they have a leg to stand on? It seems like if they live there for free, there should be no repayment. These were updates THEY wanted to do, not required for Gram. By the way, the told the famiy Gram needed them to be with her, which is a bunch of BS. She's very mobile and idependant.

    Nope, they won't.

    They benefitted from the updates by that bieng thier residence.

    You need to make sure that she has a will.

    If she dies intestate, it will follow in this order. First is husband. If he is dead, then children will be split evenly , if no children, it will go to her parents, if not her parents, then her siblings.

    Unless of course she has a will. Don't be suprised if they haven't asked her questions about that. DOn't be suprised if they haven't even actively sought an attorney if they are making statements like that.

    But the pure fact is they benefitted from the alterations, they lived there as thier primary residence. Document, Document, Document.

    If she is getting any aid, report they live there. Then they will have to document it and prove they have seperate finances. CYA

    It doesn't should very legal to me but I'm not a lawyer, which is what I advise you see. Talk to someone who specializes in estate planning. Ask him how you can pull them up short so you won't be involved in a big court battle when gram dies. If you get involved in legal proceedings no one is going to have any money left after the lawyers are through with you.

    Consult with a lawyer. Also, you and your husband should find out if Grandma has a will/living trust so when she dies everyone knows who inherits what. Grandma doesn't deserve this and hopefully, she knows that already.

    Unless there was something in writing to this effect, then they haven't a leg to stand on. Otherwise, the family just has to stand their ground and these people will have to eat the renovation costs.

    I would advise you to see an attorney. If possible, take your Gram with you.
