Question Regarding Taxes.?

My wife already has here SS# and all that. The question I have is my 2 step children do not have any documentation as far as citizenship and visas go. They dont even have a passport. They just came with there mother and the approval of there father. Am I able to fill out a W-7 form for them with out having any documentation on them yet. I was not able to list them on my taxes last year and I know I missed out on a lot of money. Is there anyway that I can file them under me.

Dont think it matters but they are from Canada

    You have to file for SS#'s first. They have no records of these children so you will be in trouble if you claim them. Ask your social security office if you can apply for SS numbers for them since their mother is a legal citizen. Then you can put them on your taxes or both of yours if you file married.

    Here in California, you'd be able to do so, I'd suggest you contact an immigration attorney, if possible or at least get some inexpensive legal advice. In CA you'd get a TIN # I don't know if it applies to minors or can be obtained for teenagers, check with your local IRS office if that's what they call it in Canada, you should be able to claim them as your dependents if you are the head of household and obviously you are supporting them. Do a google search, you just might find the answer there.

    First, their mother needs to get them their passports (Canadian).

    Second, if you have legally adopted them, then they are your children and you now need to submit the paperwork for their alien registration/citizenship. If you have NOT adopted them, then I don't think that you can do anything.

    Check with INS and SSA for better information.

    you will need to try to get theere SSN or at least a visa number saying you are supporting them as well.
