Depends perhaps how under 16 they are. 15½ and knew exactly what they were doing? Perhaps not. 7 years old - of course.

It is very difficult - the definition of an adult & child varies according to country and according to what the question is about.

In the UK, at 16 you can legally fly a light aircraft, you will have to wait another year until you are trust to drive a car. You then need to wait yet another year before you are allowed to have a pint of beer.

Yet you can join up in the armed forces at 16.

Too young to drink - old enough to die?

I wish governments would decide on ONE age where they decide someone is mature enought to take responsibility - and then stick to it. Criminal responsibility likewise

In Indiana, a juvenile is someone less than the age of 18, and offenses dedicated through those human beings are heard in juvenile courtroom. at the same time as the allegation is made adverse to the juvenile, the juvenile is observed the probation place of work the position we communicate with the juvenile and be certain(s) and then we make a suggestion to the prosecutor to even if the case ought to flow to juvenile courtroom, if it really is going to be dealt with interior our place of work on an casual adjustment, or if the case should be disregarded. there are certain offenses that are promptly waivered to human being courtroom if dedicated through someone less than 18. one in all those offenses is homicide. For different offenses, as a probation officer, if i imagine the offense is severe adequate, i'll request that the prosecutor waive the juvenile to human being courtroom. i have finished that on situations concerning a huge volume of medication at the same time as the juvenile is 17 and nearing their 18th birthday.

Yes. As a matter of fact, some would use that as an element to try and avoid prosecution. Youths today are used in entrapment cases by local police. Far as I'm concerned that's a felonious act. From both parties.

  • um it depends on situations if the child knows what the consequences are and does it then yes they should be convicted as an adult but if they don't know the consequences as a CHILD, not an adult when you are an adult you should know the law, then you should not be penalized also if a adult is raping and beating the child and his or her siblings and the child kills the person doing that then they should not even be taken to trail

I think it depends on the maturity of the offender, if it was premeditated and the circumstances of the crime. If they are tried as criminals I think they should definately receive rehabilitation counseling and treatment and be housed in a seperate facility until the end of their sentence.
