Found bugs in drink, can I sue?
A few days ago I ate breakfast at McDonalds. I drove through the drive-thru. When I got home I discovered, in great disgust, that there were a dozen or so ants in my drink. Some of them were crushed under the lid, some of them were dead. Thank God I didn't drink of it. Do I have grounds to file a suite?

Probably not. You will be ripped apart in cross-examination by McDo's expensive lawyers: proving the ants got there while the drink was in McD's custody is difficult.
Also there will doubtless be CCTV pictures that may call into doubt your version of the story.
But I'm sure McDo will give you your money back for the drink. As you didn't actually drink it you can't claim physical injury. And ants are not as shocking as, say, a cockroach or an amputated finger. Nor is ingestion of domestic ants known to be poisonous.
BTW, legally and scientifically ants are not "bugs". Or so I am told.

Anyone can sue for anyting. Doesnt mean you will win. If you did not suffer any physical injury, such as the case with the woman and the hot mcdonalds coffee it is unlikely you will win. Your attorney will win but you will not. The fact that you did not drink it pretty much eliminates any possibility for legal action. You should have thaken the drink back, asked to speak to the manager, pitched a fit and threatened to turn them into the health department. That might get you a free #4 combo. I would not advise eating at that mcdonalds after doing that however. A coworker of mine his wife drank some slimfast that failed to be picked up in the recall, the stuff that had cleaning fluid in it. Made her violently ill for a few hours. She had no grounds to sue and her lawyers advised her to just forget about it.

You can always sue--it just takes the matter of writing up an complaint and a filing fee.
The question is whether you will collect anything.
Ok--I suppose someone might have been negligent in that these ants got into your drink. I would have been disgusted and never gone there again.
But to collect on a lawsuit you gotta have damages. This means you will have to get all this pain and sufferring and mental distress.
You don't mention this. I suppose you could fake it all. But that really sucks.

why does everuone wanna sue?
did you know ants are edible, and a high source of protien?
now if they had poisoned your burger with cianide, or jacked off in your fries, i couod see being upset, but damn, thier ants!
i can also tell you that the first thing mickey-dees will say, especially after the finger in chili at wendys thing, is how do we know they didnt get put there after you bought the drink in an attempt to get money from them?
