If my husband took a drug test and failed, would this stay on his permenant record. Also, could potential employers find out this information.

Yes, it can. Many employment screening services can produce the reason for termination, which may include the failure of a drug test.

I guess you need to clarify what you mean by his permanent record. Was the test done by his probation officer or something? If that is the case then yes, the probation officer would have a record of it. If you are asking if it would appear on his criminal history, as in an NCIC entry, than no unless there was an arrest made.

Employers can't pass around that information if that is what you mean. They can only verify the dates he started and left the job.
If this was because of a DUI that would be on his DMV record and he would have to report the misdemeanor or felony that went along with it if he was convicted.
