visa and then coming back????

if a person is on student visa in US, then he gets a job over there and gets his H1 has been approved, are there still any legal formalities/complications cuz of which he still can not leave USA, and comew back to his home country for say 1 month, what r the objections, how long does it take

    Once you receive the H-1 Approval (I-797), you are legally here as an H-1. Your passport will only have the student visa stamp so you cannot leave and re-enter unless you get a visa stamp for the H-1. If you would like to enter the country (or re-enter) on your new visa, you'll have to go to the Embassy and get an H-1B visa stamp for your passport.
