eBay problem?
I'm having a nightmare with ebay at the mo, I sold an item which the buyer decided wasnt good enough and returned for a refund, I've sent him a cheque but he's saying he hasnt received it and is taking legal action to get his money back, the item was only worth £30, what can I do other than keep sending him cheques, should I be worried about legal action? I aint using ebay after this again I tell ya!
No the cheque hasnt been cashed and I sent it by recorded delivery to make sure he got it. I've run out of cheques until my next cheque book comes so I've sent him a refund via paypal, I hope he accepts this as I really dont want legal action agains me!

Don't worry about it. The best he can do is some kind of Small Claims Tribunal or such- they couldn't be fukkked over 30 squids.
Ask for his bank details, write an apology through eBay to him and have it sent to your email as well.
Direct deposit into his account and cancel the cheque.
Simple- then you'll have proofed you've done the right thing.
Unfortunately eBay is 75% chavs & tossers (Yahoo crowd excluded) who unrealistically expect stuff for almost free. They can be a real pain in the arrse.

Have you got proof that you sent the cheque? If the cheque has not been received or has become lost in the post then cancel it and issue another one. Check that the cheque has not been cashed first, then issue a new one once the first cheque has been stopped.

So why is it Ebays problem!
It's your item and as long as it was advertised correctly the buyer has no real comeback - it's called 'buyer beware'.
If you are happy to refund him the money then that is up to you. I don't see how it is Ebays fault. Personally, I would have told him that the advert was correct and the description was all in order and then told him 'tough luck'.
If you must send him his money back - cancel the other cheque and wait for a few days to make sure it is OK! Then send a replacement cheque.
Unless your auction detail was so far off the proper description he has no comeback legally

Hey I have found eBay a good tool and most people are fair to trade with don't worry about legal action. Cancel all previous cheques offer a bankers cheque it may cost 2 or 3 pound more and forget him.

stop all the cheques you have sent if paypal was used then he will have to except the refund as you have been fair and done what was expected of you ... if there was a dispute use ebay they are good at sorting things out quickly usually only refunds should be honoured if the item wasnt as described and that you would except a return policy if not then it is sold as is

You said you sent the cheque by recorded delivery...have you confirmed that it was received?
Go to www.Royalmail.com and in the "track & trace" section put in the number on the orange slip. You'll see the time and date of delivery, and you should also be able to click on "see proof of delivery" where the recipient's signature will be displayed.
Then at least you can tell the buyer that you have proof he received the cheque - it's his problem if he lost it afterwards!

Sending the refund via paypal means it is over. Cancel the original check you sent and don't worry about it. He can fight it all he wants but paypal is about the securist way you could have sent it, and he can't claim you didn't. As for legal action, nothing will come of that. If they ebay or paypal contacts you for any information, give them your proof. Don't respond to emails by clicking links in them. Go directly to the ebay, or paypal website.

If he is angry with you, he might be holding the cheque just so he can cause trouble and take legal action in order to hurt you. Stop payment on all checques. Give the slacker a refund through PayPal.
Don't stop selling on Ebay just because of one wanker.

The person who bid on your item is his porblem, check with your bank 2 see if the cheque has been cashed, i use e-bay and sell item and Offter No Refund for the item next time on your e-bay list
