How do I get a judge to dismiss this ticket?

Traffic was heavy and upon pulling out of a grocery store to a main street I had waited around 5-10 minutes for three lanes of traffic to stop blocking the intersection and waive me out into the clear. I proceeded to pull forward (car facing west) to go south bound and was struck on my drivers side fender. The individual that struck my vehicle was driving in the lane with double yellow lines (suicide lane) to bypass traffic more than 50 ft before his turn. ALSO he was driving under a suspended license with no vehicle insurance.......he went to jail for driving under a suspended license but I got sited for the accident for "failure to yield" so even though he was negligent I got the ticket for the way our cars were positioned. unfortunately, the officer that showed up was training another officer so a ticket had to be given. Is there a statue stating if an accident happens after other drivers OK you to proceed it's their fault? what can i do for my defense?

    Its your respnsibility to enter a lane where others have the right of way safely to avert collision- so you were cited correctly.

    That being said, if you can get a statement from a witness stating that you were waved forward into the intersection, the judge 'might' allow that the improper pass was the cause of the collision and not your turn maneuver.

    In the future, turn right until you can make a u-turn. Its safer and a hell of alot faster than waiting for the off chance you can make a left across 3 lanes!

    Regarless of the other drivers license status YOU have an obligation to make sure traffic is clear before entering the traffic lane. As the other vehicle was already in the traffic lane, REGARDELSS of where he was, if he was occupying a lane the responsibilty is yours to make sure it is safe before merging.

    I believe you were properly cited. That being said there is nothing wrong with showing up for court and hoping for the best.

    You've been properly charged. Pay the ticket or go to school. The only way you'll get out of it in court is if either the cop or the oter driver doesn't show up.

    With a gun....... He is part of the system to separate you from your cash and that's all that is to it.
