What's the difference between DUI and DWI....?

    To the best of my knowlege, there's effectively no difference. The only thing I can think of is that a person can be under the influence of something (for instance, prescription medication) without being "intoxicated." As far as the laws go, I personally think of DUI as being more inclusive than DWI, but that's just my take, and by no means a legal definition.

    Everyone thinks that they are one and the same, but they are not. DUI is the charge you will get if you are intoxicated or otherwise under the influence of anything else. DWI, which stands for driving while imparied, can be anything from driving drunk (but not blowing over the limit) or for driving while tired. Yes, you can get a DWI for driving too tired. Impaired is the key word here. If I pull you over and you fail your field sobriety test, but pass the legal limit I will charge you with DWI, if you fail both, I will charge you with DUI.

    No difference in California. DWI, DUI, Deuce - it's all the same. See CVC 23152 (among other sections of the CAlif Vehicle Code).

    In ohio, where i was arrested 20 years ago and it was explained to me, A DWI is when you blow into the breathalyzer and fail. A DUI, is up to the judgment of the officer. That's what I was given after I passed the breathalyzer. The fines and penalties are exactly the same. The DUI easier to beat because obviously they have less evedince against you, mine got totally thrown out. thanks to the breathalyzer results.

  • One thing that different is DUI is driving under the influence of booze and drugs or just drugs. DWI is driving while intoxicated or just plain drunk.......

    Same thing. Driving Under the Influence, Driving While Intoxicated. There are more charges under the offense.

    driving while intoxicated is more severe than driving under the influence because the blood alcohol content when you're intoxicated is higher than when you're just "under the influence"

    the levels vary from state to state, i've heard from some friends that when u get a DWI you have to go to drunk driving class(where they teach you how not to get caught driving drunk), and you get points from your license...

    It's different terms for the same things. Different jurisdictions use different terms.

    Driving under the influence and Driving while intoxicated are just two different terms for one thing.
