Can an agreement be made between the employer in the State of GA to receive regular pay instead of overtime?

I work for a private company that does not issue overtime for the hours worked past 40 hours weekly. Can there be an exchange for comp time? What are the laws?

I am an multi-tasking office assistant my pay is over minimum wage.

I get paid every week.

    It depends on the classification of your job, and whether, if you took the total hours worked and divided by your salary, if you fall less than minimum wage.

    Whether there is an exchange for comp time is at the companies discretion. however, the calculation for hourly rate is based on a pay period, so if you get paid once a month, they may require that the comp time be taken in the same month as the over time (at least if they were smart that is what they would do).

    Georgia is an "at will state" as far as employment is concerned. From what you have presented in your question... it seems logical and obvious that under Georgia state laws, your position is as a salaried employee.

    If that is true, as long as you're earning over minimum wage for the amount of hours worked, you have no other recourse.

    However, you can request an meet with your employer to discuss wages, and earnings, and if you come to an agreement... be sure to get it in writing and make sure a copy of the agreement is entered into your employee file.

    They can exchange comp time for overtime, however, comp time must be given based on time and a half hours. In other words if your work 50 hours, you get paid for 40 hours and can take comp time of 15 hours (10 X 1.5) See: http://w3.lexis-nexis.com/hottopics/gacode/default...
