What is the procedure of getting married in court in India? Please help me ..?

I am a catholic girl (Roman Catholic) .I am in love with a catholic guy,and we want to get married .Our family members know that we are in love and we want to get married .

My guy 's parents have already agreed for our marriage .But starting my guy 's mom was against me and his relationship .But for his happiness his mom agreed for our marriage.

But my mom is against me and my guy getting married .When ever I talk about him , she makes a big issue our of it.

I love my guy more than my life and I want to get married to him .I have convenced him to get married to me in court thats a register marriage. And I dont want my parents to know about our court marriage .I want to stay in my house for 3 years because he wants to stand on his own feet .I can't wait for a long time .I want to get married to him as soon as possible . I know that legally that the man can get married at the age of 21 and the girl can get married at 18 years .I can also get 2 witness from my side (My friends)

Can i get married to him without my parents knowing about our marriage at for 3 years, then later i will tell them .Because it would take time for my mom to like my guy.And i dont want to wait longer.

The other thing is some times I get scared if his mom changes her mind.Because he is also getting very good proposals.

    Hey,

    I know all this sounds really cool and very filmy.... getting married... hiding for years to be accepted.... etc, etc.

    But let me just tell u one thing.... i had a religious marriage only... with the love of my life. We left home and without our parents permission we married. Well things have been extremely good for us. The catch is my parents adore him.... where as his parents haven't even seen me once. They are so against it that his mom wont even let him talk abt it in his house. He maintains a pretty good relationship with them... but they never talk abt his marriage. We have now been married for 6 years... and iam still waiting for them to accept our marriage so we can go ahead and have a happy legal marriage atleast.

    You can do watever u want..... but dont expect it to go ur way. So instead of getting urself into a lot of trouble.... talk to ur mom abt this guy... 24 X 7.

    Atleast now u have his parents support.... dont ruin that also by getting married and hiding it all. They will also blame u for having made him do that.

    If you trust this guy and urself.... dont push things so much. Take ur time... give him his time.... ur mom her time.... and his mom her time. You just be a SUGAR... keep them all impressed.

    No matter how many good proposal he gets.... u should be the only one he loves. This u both have to work on together.

    You want to hide your marriage for 3 years. Why get married? Just wait out the 3 years if both of you have faith in each other. In this way no one is cheating or hiding anything. This will also be a good way to test each others love. If he changes his mind it should be okay as both of you are not married. Can you imagine that during that time if you are married and he leaves you or change his mind? Think properly and wisely before jumping into a marriage and staying away for 3 years. What are you thinking?

    Under Special Marriage Act you have to apply before Executive Magistrate [Dy. Collector in -charge. ] One month's notice is issued to general public inviting objections if any and the notice is exhibited on notice board of the court. After completion of such period if there is no objection and if there is some one deciding the same marriage is solemnised and certificate is issued to that extent. Age should be male 21 ,female 18. This is normal procedure and other formalities according to circumstances of the case.

    Court marriage as you call it is solemnized under the Special Marriage Act, 1954 all such marriages can take place between any two Indian citizens as well one Indian citizen with a foreigner irrespective of their religion, caste or creed, and you can say this is the secular form of marriage available in our country. Such a marriage is solemnized before the marriage officer/registrar usually D.C. deputy commissioner of the area (Sub registrar/SDM is the marriage officer/registrar only in case the already solemnized marriage under any other Act has to be registered) where both or any of the parties to such a marriage reside permanently or for at least one month. Cost of such a marriage is merely Rs90/- or as the rate prevalent in your area. Now how you proceed? Both the parties to the marriage file a joint application before the marriage officer along with individual affidavit attested by notary public specifying the age(boy 21yrs &girl 18yrs), place of residence, marital status(unmarried or divorcee as the case maybe), mental status(not idiot or not with unfit mind), not related to each other. Along with this you have to give proof of age( School certificate, Passport,) , proof of residence(Passport, ration card, voters id card, PAN card, rent agreement) , & the application of such a marriage should be witnessed by 3 independent adult persons, affix one photograph of each of the parties & all the 3 witnesses. You have made such an application/notice to the marriage officer in person along with all the 3 witnesses. On receiving such an application the marriage officer issues a month notice regarding the intended marriage & get such a notice affixed on the notice board out side his office, a copy of such notice is sent to the marriage officer under whose jurisdiction the other party lives, also a copy is to the individual parties address. After expiry of the period of notice a date is fixed on which all the persons parties to the marriage & 3 witnesses appear again before the marriage officer who declare them married & issue a certificate to this regard. Incase of any objections raised the marriage officer will settle these objections. Now what can be objections that can be raised? These can ONLY BE REGARDING THE CONDITIONS NECESSARY FOR SUCH MARIAGE & NOTHING ELSE. What are the conditions? As I stated above i.e. Age, martial status, mental status, prohibited relationship (related to each other by blood). This is the brief procedure I have told you here, incase you want any clarification you can ask.

    ok the scenario seems to be critical.. no one can give a precise or a correct decisions for this without knowing the constraints you r facing but, any how there would many solutions that u would take on..

    1st of all if both are majors then it would be safer and legal.. you can ask for protection from the court wen u r married if u get any sort of troubles from either side of the family.. i understood that u r so fond of him ..that is ok..but before that please analyse or think about him.. whether he stands with u at any critical point of time in future and whether he is dare enuf to face the issues.. you confirm then go ahead.. u can go to any good advocate and reveal the issue about ur marriage to any good advocate/lawyer.. he would suggest you better legally and u can get married legally.. he would also suggest you how to be safe and what all the protection that u can get from the police wen u r in troble with eitherside of ur familes...

    Please think of your partner.. analyse and then take a decision..

    all you need is two witness from both the sides.go to the register office in any town and register.they will give you a certificate.thats it you are married legally.

    both of you should be major and with two witnesses you can register your marriage. However both's consent is must.
