Although his TB was not active and contagious, knowing that it is a resistant type, my opinion is that he showed poor judgement.

He was told when he left that he was not a health threat.
He was contacted and told in Europe that he needed treatment. He thought that if he did not get to Denver that he would not be able to have treatment and might die.
The guy was scared and made a poor choice. He did not break any laws, though. But I think it is clear to him what his choice should have been and I think this will follow him for a very, very long time.
