can i get in trouble for not having insurance even though they hit me from behind?

what can happen if they hit me from behind but im the one with no insurance .someone told im responsible for all the damages even though i got hit from behind is this true why if i didnt hit him

Update:

i know i dont have insurance people but why would i have to pay all the damages if they hit me? experts only i want to hear facts not opinions

    you would get in trouble because it is illegal to drive without insurance plain and simple, your car should have never been on the road in the first place

    You might not be responsible for the actual accident -- it's more complicated than you just getting hit from behind. But you might get a ticket and be otherwise liable for not having insurance. Also, you're going to end up paying money out of pocket for an attorney if they are trying to sue you or make you responsible -- you're not, from what you said, but you'll need a lawyer to defend it for you and that costs money. That's also why it's better to have insurance, so the insurance company can do the fighting for you.

    Two different issues. Liability for the accident doesnt change when you do not have insurance. .However, you will get arrested for not having insurance if your state requires it. By the way, not all people who hit cars from behind cause the accident. You may have done something to cause it, or you may at least be partially at fault. If that is the case, you may be coming out of pocket for big bucks.

    It depends on the laws in your state. I've heard that as well, though I don't know if it's true. My mother got hit once, uninsured, and we were terrified that she would get in trouble or something. The other people were at fault, though, and their insurance company sent my mom a check.

    Not to get preachy, but you should really get insurance. I drove without it for a time in college and ended up paying for it for years. Literally. And I was lucky, it wasn't as if I was sued for personal injuries or anything like that--it was just the damage to the other guy's car. PLEASE get insurance or don't drive. You could really mess up your future.

    You would not be liable for any damages caused by another driver even if you don't have insurance. You could get a ticket for not having liability insurance, though. There are two parts to auto insurance - liability & collision. Collision covers you and your car in the event you wreck it, and you don't have to have it. Liability covers other parties involved in an accident caused by you, and therefore it's mandatory. Just liability is very affordable and it's against the law to drive without it .

    I guess it would depend on what state you live in. In my state you are required to have auto insurance. If I were to get hit from behind and policeman showed up to take the accident report he could impound my car for not having proof of insurance.

  • Yes becuse if you live in a state that mandates that you must have auto ins. then you should not even be on the road with out it. If you get hit hit, according to the law, you werent supposed to be there in the first place and it is 100% your fault.

    The laws probably vary from state to state, but in general they are still at fault but you can be cited for not having insurance which around here is $500.00 dollars a pop!

    correct you are at fault because it is illegal to drive a car with out having insurance... they could hit you head on, from the back or any other direction it doesn't matter cuz your not allowed to drive if you are uninsured

    you could get sued by insurance company of the person who hit you to cover their expenses. you have to have insurance to drive. by not having it you are not driving legally and hence they would have a case against you.
