spoiler alert::
draco disarrmed dumbledore in book six. dumbledore's wand was the elder wand, so it transferred it's allegence to draco. when harry disarrmed draco in book 7 the elder wand then recognised harry as it's master, even though draco had not taken the wand from dumbledor, and therefore did not have actual possession of the wand
it's not really about who takes it, but who *defeats* it's previous master.

SPOILER!!!
I had the same question. In the 6th book, when Dumbldore cast a spell to make Harry not move or speak, Draco diarmed Dumbledore. He won Dumbledore's wand, the Elder Wand, so he is now the true owner of the Elder wand. So technically, Snape's death was not necessary. You don't have to kill the person to get the Elder Wand. Voldemort just didn't know that Draco had actually won it.

In book 6, when Dumbledore allowed Draco to disarm him on the tower. I say allowed, because Dumbledore could have never been defeated by Draco since Dumbledore had possession of the Elder wand and was its master at the time.
It is in book 7 that we find out about Dunbledore's plan. He tells Harry the events on the tower the night he (Dumbledore) dies. This happens when Harry "dies".
What confuses Voldemort is that Draco was already the master of the Elder wand (even if he did not know this or have possession of the wand) when Snape kills Dumbledore. Snape was never the master of the Elder wand, so Voldemort was never the master of it either.

It has nothing to do with choice. The Elder Wand transfers to a new owner when the current owner is overpowered by someone else. The "overpowerer" then becomes the new owner. You don't necessarily have to use magic to overpower the current owner. Simply taking the wand by force will also work, as Harry does at Malfoy Manor. Draco disarmed Dumbledore in Half-Blood Prince, and therefore, without being aware of it himself, became the new owner.

That can be found in the 6th book. Draco disarmed Dumbledore before Snape killed him. That means he was able to conquer the owner of the elder wand (you don't really have to kill the wand's owner to become the true master), making him the true master :-)

It choose Draco as a master when Draco disarmed Dumbledore in the end of the sixth book, the wand belonged to Dumbledore previously. When Snape killed Dumbledore, he was already disarmed, and Dumbledore said to Snape to kill him, so that's why the wand didn't choose Snape as a master.

Draco disarmed Dumbledore in HBP. The Elder Wand never ''chose'' him.
Source(s): i asked myself the same question, so I reread HBP - 1 decade ago
in the 6th book draco use a spell on dumberdore and his wand came out of his hand prior to snape whacking him.....
