is it against the law to record a phone conversation if you dont tell the other person?

Virtually all states are one party states. That means as long as one of the parties on the phone knows the call is being recorded it is legal. Only CA,CT,DE,FL,MA,MD,MT,NH and Washington State are two party states where both sides of the telephone conversation need to know they are being recorded. Hope this helps.
Source(s): Arizona is a no party state where neither party needs top be aware the call is being recorded. Of course this becomes moot if the call is going outside of the state. - Brian ALv 71 decade ago
Most states are one-party consent states, meaning it is okay for you to record YOUR conversations without notifying the other party. My source website has some good information on the different state laws.

It's not against the law to make a recording, but it would not be allowed to be used as evidence in a trial unless it was made with consent and you could prove that such consent was obtained.

I think so, that's why they(generally) tell you first, I'm guessing so, you can watch what you say, or hang up... lol
But, even if it was legal, doesn't that sound a little
unethical, to record a conversation without someone's knowledge? You have to be careful with that, I heard people
can sue over stuff like that. (It could go under invasion of privacy)
Good Luck

In most states, except Oregon. Dr Phil flew to Oregon to record some phonecalls when he was stinging a ring of impersonators. He explained the legality. Not sure what other states, though.

It depends on the jurisdiction. some states' laws say one person has to agree to be recorded...that person can be the one doing the recording.
