Pre employment drug screening?

I got a job as a security guard for a private security company in NJ....they told me that i have to come back tomorrow to take a drug test in the office.....Is it even legal for them to make me take a drug test in the office and not in a lab.....also can my employer come in and watch me give the specimen????Serious answers only please. Thanks

    Yes, your employer can conduct the drug test however they like. It's cheaper for them to do it then to send you to a lab.

  • There are a number of do-it-yourself instant drug kits out there, so YES, it is legal for them to make you take a drug test in the office. If it is negative, then the test has been successfully completed and you can begin working. But, if there is a positive, then a laboratory confirmation MUST be obtained. But the only catch is that you have to prepay the cost of sending it to the lab (of your choice), which at most is $50.

    They can come in and "watch". Has to be a male (if you're male)/female (if you're female), and this is to make sure you are actually urinating in the sample cup, and not using someone elses urine.

    I don't know of any legal prohibition against this practice, which has become almost universal. They can choose where it's administered, but I think I'd be a little leery unless it was done in a lab. I might ask if I had the option of going to a lab. If it's done at the business, specimen collection has to be witnessed, but not directly. They can stand by the open door, etc. Problem is, if it's not done in a lab, you have no way to guarantee the chain of custody and that no one has contaminated it deliberately, and they have no way to prove you didn't just put a baggie of urine in your pocket. It's not a wise practice for either of you.

    I am an owner of a trucking co and by the fedral standards we test our driver according to DOT regulations barbituates, marijuanna, methamphetimens, cocain, phencyclidine, opiates. These are what we test for and as far as I know it's a pretty common drug panel for most employers. Some prescriptions can make you pop positive, however the MRO (the dr that reads your test result) will call you and ask what medication you are on if you pop positive. If you have a valid prescription in your name there will not be an issue, but they may ask you to test again. If you took something like asprin tylenol, excedrin etc it WILL NOT MAKE YOU POP POSITIVE. If you took something like Darvocet it will pop you positive. But you did state you took the medication a few days ago as long as it wasn't within 72 hrs, you should be okay. I hope this helps you.

    Yes it's legal. You must be in constant observance of your specimen. You must witness them sealing it with tamper proof tape. You must sign or initial the tape if to your satisfaction. The specimen is then placed in a clear plastic baggie from the Lab which is also sealed. This is also signed or initialed by you. Then it must be observed by you being dropped into a locked container from the Lab. This is the law. If the results are positive you must be informed as this is a precursor to employment. Positive results which negate employment can be appealed.

    Yes it is legal. They are the ones paying for it. You sound pretty worried about it. If your afraid of failing and plan on quitting talk with your employer. Let them know that you recently quit and will most likely fail, however you would like to prove it in a month or so. You are a liability to them and all the people you serve.

    It's legal, but its a little shady that they don't send you to a lab to give the specimen. Its not common for them to actually physically witness you give the specimen, thats usually reserved for military and probabtion/parole officers to do.

    It is completely legal. They can show that drug use has a direct effect on your ability to do the job. Sorry, it's intrusive but completely ok.

    each state is different. i would check it all out first to make sure the company wasn't corrupt.
