you all have great ideas. but i think im going to go with just getting a new one and returning the old one.
i know for a fact that its not the headphones or the mp3 file. or the volume thing. so i think returning it is the best way to go. :_

When I first received mine the same thing happened. It might be the headphones. Try using a different pair. If that doesn't work, and you got your ipod from apple.com go to apple.com and fill out a form and what the problem is from the support button.

check if its the music file or the head phones
also check the setting for the max volume level
if none of that works get a new one or get it fixed at a store
