H1B question?

Can someone illegal or out of status for 2 years get sponsored or get an employer to pay for his H1B??

    A person who is out of status or here illegally cannot adjust status in the US. So, they would have to leave the US to even apply for the visa. However, being in the US illegally for over a year is a visa ineligibility, and that person would be barred from receiving any other visa for 10 years.

    I doubt it. A H1B is a capped visa, and the company has to prove that they can not get an American to do that job. You been out of status for 2 years, I doubt very much they would approve a visa

    he can get a company to sponsor him a h1b visa but he will have a hard time getting it approved. this is because he has to provide the proof of his current status and it expire date, and i-94 document to USCIS with the h1b application. Good Luck
