No and yes. Go in, in person to apply. A person needs to have been laid off or put off work by their Doctor to collect unemployment. However, if you felt that the environment that you had to work in was unsafe, they might push through claim. You have to have a really good reason though and they would probably want to you to make a formal complaint.

If you have a good Doctor that you are close to, you can get your Doctor to give you a note(they will also have to fill out a form that you have to submit), saying that you have been having really bad anxiety from having to work under this stress and because you are feeling harrased. Now your claim has changed to a disability claim and as long as you have a good enough answer as to why you didn't go to the Doctor before you quit(to get a note for leave) they will probably push through and let you submit your claim.

A good reason for not calling or seeing the Doctor first is "I don't know why I didn't go to the Doctor first. I guess I was scarred and embarassed. I never thought that I would let a person treat me this way, but when the anxiety attacks come I feel so helpless and that helplessness carries on to all other aspects of my life.

If they ask you why you didn't just quit and find another job, you will have to have a good answer for that as well. They will ask you a lot of questions, so be prepared.

You can certainly file, most of the filing now days is done on line or over the phone for this benefit. You will be required to go to the unemployment office for a meeting though once you do file. You are probably not going to be eligible as when you did not show up for work that would be considered "voluntary termination" - in other words, you quit the job, no matter what the reason. They can assist you in finding another job though and is a very good resource. On your resume, when you list this position for future reference, I would list that you vacated this position due to "personal" reasons and if asked in an interview just let them know that you agreed to disagree and leave it at that. Rules vary by state. Can look at your situation as either you quit or were fired. In general an employee can NOT get unemployment if they quit. There are a few exceptions the one closest to your situation would be if you formally complained about sexual harassment to those over your manager or HR and nothing was done to fix the situation.

Going with the termination due to absenteeism. All states allow the employer to terminate employees who do not show up to work. The state courts also consider this to be a major offense (misconduct) and do not provide unemployment benefits for those terminated for misconduct.

So, either way you look at your situation, you will not be allowed to get unemployment benefits. Next time someone sexually harasses, inappropriately touches you at work, report this to his boss.

It really depends upon what state you're in. However, since you did quit with good cause (sexual harassment) you may be able to draw the unemployment compensation, unless the dirt-bag files to stop it, in which case you need to file a law suit against him and the company. Probably should have done that anyway.

It depends on the laws of your state. you don't get unemployment if you leave the job voluntarily, but when you are fired, you can be denied if the employer protests your claim.

Did you ever tell your boss not to touch you? I would immediately report this to the person in charge of the company. Then to the state unemployment office.

That is sexual harassment and your boss sounds like scum. I am not sure about unemployment because I am not from the US, but the best way to find out is to contact social services and find out. It is disgusting that he might get away with this. I would report him as it will also help your case. Good luck

This will depend in which country you are. If your from the UK then yes if they fired you. However to be honest you should report him as this will be classified as sexual harassment. Remember you reporting this could stop someone else from be harassed in a similar manner.

You would not have any unemployment if you have only worked 2 freaking days. And you don't get unemployment for a part time job.

Sounds like you should have filed a sexual harassment suit.

I'm almost certain you can't. Since you were fired "for cause", that is, for not going to work, you'll be disqualified for unemployment compensation.
