Employer not acting on payroll mistake and I haven't received my check, help?

I received my paystub and it was short a week's pay. I looked at my bank account and nothing has been deposited. So, I have been paid nothing and my manager told me I have to wait 5 days before I can speak with someone in the payroll dept. I told her she should speak with them and I need the money in my account by 2pm Monday afternoon because of bills.

She shrugged her shoulders and walked off.

I know she is acting like a horrible manager, but is she breaking any laws or rules by not caring and not getting me paid for what looks like will be over a week late after I finally can get payroll involved. Money is tight right now and I need to pay some bills Monday to avoid late fees and credit problems.

What legal position do I have, if any?

    Call your Human Resource Rep if the company is of any size. If its small - call your local labor board.

    First rule of management is not to sit on payroll issues. It can create morale and legal issues very quickly.

    I'm not exactly sure but i would contact your states department of labor and tel them about the situation, If they are violating a law they could be fined and those fines are not cheap, like $5,000 or more,

    As far as suing them an atttorney would cost more than probably your check would be.
