What a Mess my Brother and sister in law are in there divorce , and shocked at outcome,anyone please?

My Sister in law had an 7 month affair that was exposed to everyone who known these people.

The divorce was my bother (1/2) who has challenged the NOFAULT RULE in Ca., stating the affair was the primary cause of divorce and asked the JUDGE for a CAUSE OF ACTION with detail so as to sue his wife for custody, and majority potion of the community property!

HE GOT IT on all counts and got 90% of the community property as well as physical custody of the children because he proved that his wife started to CO- habituate with individual who she was having the AFFAIR WITH and did not want his kids around the man!

Now let me say this I think the whole think STINKS to high HEAVEN, and both party's need to grow up, that said I can't fathom how this woman had the affair, how the LAWS of NO FAULT could be side stepped like this.

I practice Financial Meadion so I'm out of element on subject .

HAS ANYONE HERE HEARD OF THIS BEING APPIED TO DIVORCE LAWS?

    yes i have heard and seen this my mother was a attorney for 22 years it is a more common outcome than you might think it is never easy for anyone but it is most unfair to any children involved. things everyone should remember prior to cheating, why are you about to break your word and stray from your spouse and is the possible end result something you can live with. sry to hear this happened to more children

    My assumption was that the no fault rule was favored by most courts because it keeps them out of emotional battles that often have nothing to do with the legal seperation.

    I think it's about time they start allowing this sort of thing again. It's starting to get ridiculous that people are getting married multiple times and there is no implication for them in divorce. So you are saying that the court is making a judgement in favor of a man based on the facts? Bravo!

    Men have always had reason to fear divorce, now women can have some implication as well. Equality is awesome!

    Who cares what ya think, as long as the kids are with the most stable person from this crashed marriage!! I got my children from my 1st marriage,(not in the same way), but they grew up to be responsible adults,raising responsible children!! Now whats wrong w/ this story, nothing, nothing at all, their mom still lives like she's 25, and is well 50+.

    I agree with the folks above that she got what she deserved. No fault divorce was one of the biggest liberal agenda reform mistakes that I can recall in my 51 years of living.

    sounds like it should happen more often to cheating spouses. i have never heard of it, but she got exactly what she deserved, its time that the courts change their way of seeing things, and the betraying partner gets their just due. maybe if this were the normal thing there would be less cheating and more trying to work out problems.

    Now, if he decides that he wants to start dating again, can their children be around his new gf? If that is so, then no it isn't fair. I don't think that husband/wife should be able to decide who the children are around as long as it is not dentrimental to them.

    If the law were more strict perhaps people would take there marriage vows more seriously. She deserved it.

    NOPE..and I got my divorce in CA. There was only ONE choice; IRRECONCILABLE DIFFERENCES. It was the only box you can check on the forms. Seems like someone's attorney did some tricky stuff....money talks.....

    It is very fair that he got everything. She lied and was unfaithful so she looses
