My ex spouse is filing bankruptcy, I'm being sued for medical bills .?
Is this going to come back on me all of it? Can he do this. These are his bills we were seperated at the time these bills were acumilated. I did not know of these bills I recieved no medical bills in the mail.I was unaware.

Separated or divorced? Big difference.Also, in your divorce decree, did you have it written that any or all bills were assumed by either or both parties?In your divorce degree,it will or should state,which bills either party will be responsible for paying. eg, charge bills, medicals, etc. Regardless, alot of factors make the differences. Once you were divorced, any expenses contracted by the other party, becomes the parties who creates them. So, if your spouse created the expense, and your were divorced, you have no problem. If on the other hand, these bills were created BEFORE you divorce was finalized, and there is no specifics to address them in your divorce degree, you not only can be sued for them, the only way you can avoid the cost, is to fill for bankruptcy yourself.. It all comes down to when you were officially divorced, and how the documentation was handled..

Were you legally seperated? If not, then they may have a case. Do you have proof, that you stayed at a seperate residence when the bills were aquired? How long ago was the last payment made (at what point did the bills become deliquent)? If over the statute of limitation (in California, that is 4 years) then they have no right to sue. You may need to see a professional. Good luck.

If you were legally seperated you may find relief..but if you two just went your ways..then if you live in a community property state..then you may be out of luck.
But if he filed bankruptcy then I don't see how they can come after you if he listed them as a debt...talk with a bankruptcy atty to find out more.
