The first day to e-file is Jan. 11th. It is normally the second Friday in January. It is true that the IRS may delay things this year but the latest news from them seems to suggest that all that is going to be delayed will be refunds for those that exceeded the income limits BEFORE the patch was approved.

The IRS site doesn't have the "official" date up on it yet, but typically it's right around the 15th of January or so. Expect them to announce it formally any day now.

While it will take a while for the IRS to reprogram their computer systems due to the AMT patch finally passed by Congress, this won't delay filing. But it may well delay the processing of your return if the AMT would kick in under the old rules without the patch.

Depending upon your tax situation, AMT could kick in for Single taxpayers with incomes as low as $45,000 per year. That was a princely sum back in 1969 when it first was passed into law but with inflation since then it's barely enough to make ends meet in some parts of the country. The best that you can do is wait for the e-filing dates to be announced formally and then file and pray that any refund isn't delayed too much.

There is the possibility that the opening of efiling to the IRS could be delayed into February of 2008 because of the latest issue with the AMT patch.

However, this is an unofficial answer and something I heard from tax personnel at my firm.

Usually, efiling is open in mid-January.

The other part to remember is that even if you can e-file in mid January, the tax laws are still being massaged in Congress.

If you file that early, you might end up having to amend your returns due to last minute changes to the tax code.
