Can soemone that is on this site that knows Florida custody Law can tell me if x have a case?
in may 2000 my divorce w/X was final he live about 5 minute walk from my chjildren & I he stated to his family so he can see them well he never did, i remarried in 2004 I left him the children while i settle in a foreign country (france) I called 3x day and buy food, clothing for my children during the months of separation I fligh home evry 2 months and stay 3wks to a month at a time the younger one 8 at the time stated that he want to be with my husband & I so we make an appointment with his father(myx) and discuss that we will take him with us
(Now I have full custody of the children and have never give them up) after I left with the child abotu a month later he called the police and accuse me of kinapping the police ask him who has custody becasue it was me nothing can be done, anyway he took me to court he told the court that he doesn't want the children waht he wants was for me to stay in Florida and take care of them the judge told him that it was not his choice and granted me
the right to leave with my children, but because the other 2 was about to graduate the judge say that the can stay with him to finish school, that 2006 in may 2006 the 2 children move out one of them because he was only 13 the x has to sign an application for me to get his passport done to travel which he did
the other one was 16 and he wishes to left the father as well he graduate h/s but the father did not show up, nor has he asked what college is he going now he is 18 still live at my home which is 5 minute form his dad but never see him
make the story short, on November 2006 I received a letter from a lawyer accusing me of kinapping the 13 now 15 years my x asked that for the court to put me to jail for that and should return the child to him as well as paying child support, I want to know if my children & I will have justice, will the law be fair in this matter because my thoughts are Where are you God, when aim I evergoing to have peace from this man
I do have a lawyer since 2006 and he is working on it, the problem is the stress this is creating on my family life, the children are worried & so am I
because I want my children to be with me and they are so happy here
won't put any more detail I promise, but I never abodonnning paper were file to have tehm stay with him for 6 months I fix thing in France and I keep my home in Florida just for them I arrange to have their allowance deliver to them weekly for school, and I call the schools every week for a report I was constantly on the internet with the teachers, I actually make all the docs appointments including dentist to fit my vistit which was every 2 imagine my children stay with him for 6 months I flown to florida 4x the court realized that he never even have them for a total of 3month periods
I will flight hime just for a school play because he refuse to go and I just could not have one of my babies without a parent attending
so beleive me the court knows how much Ilove those children and the only time I will leave them behind is when God take me

I think you may have a case against your ex for filing false allegations of kidnapping which I believe is a felony since this is the second time he has done it...I think you need to ask your attorney to talk to the prosecutor and see if they would be willing to press charges against your ex. I live and practice in Orlando, but I am not a family attorney. I can say that if the letter did not come from the District Attorney's office and you are not being charged, then do not worry. It appears that your ex may have gone to the DA's office first only to be told that they could not file charges because you never lost custody, so instead he went to a jack in the box attorney who will write anything in a letter for a few. Its a scare tactic and as long as the letter doesnt come from the state of Florida or the Feds then ignore it. As far as where is GOD, He has been with you the whole time because you are DARN lucky to still have custody of your kids after abandoning them and leaving the country. Regardless of the situation it is called abandonment and your ex could have gained custody easily at that time so maybe you should be a little more thankful. I've known women who have never gained custody back and its sad. Count your blessings.

Being a judge granted you permission to take the children out of the country and he didn't fight it, all he can do is re-file for custody. But you hit the nail on the head, as long as the kids are underage, he is going to use them to try to control you. Send copies of everything that has been sent to you about the kidnapping to your lawyer that handled the original case and let them look into the threats.
