Everyone knows that head injuries often lead to a victim dying?

Should people who kick others in the head be charged with murder or at least attepted murder if the victim recovers

    People are often charged and indeed convicted under these circumstances.

    To obtain a successful conviction for attempted murder you would have to show that at the time of the attack the intention was to kill with malice and aforethought.

    This is somewhat tricky in most "street fights".

    If I shoot you the clearly I must know that there is a very very high likelihood of death.

    However many people (including me) have survived kicks to the head.

    With improved medical technology, head injuries no longer lead to death in most cases. The ability we have now to keep someone alive is phenomenal. There still will always be some amount of brain damage, but it's usually so slight as to be unnoticeable. So no, kicking someone in the head, even on purpose, should not be considered attempted murder.

    Once again, it depends on the situation. You can not just say anyone who kicks someone in the head should be charged with an attempted murder charge. What if its some sort of martial arts performance that goes awry? Or if its some other sort of accident?

    It depends on the severity of the attack, and the circumstances surrounding the attack, and the consequences.

    If your talking about the jena 6, then yes 6 men kicking and beating up on one person, can be considered attempted murder.

    I don't know where you get your facts but you are incorrect in your claim that head injuries often lead to death because that is completely false.

    quite often they are charged with attempt but i feel more should be.if anyone dose that no matter the reason they know the consequence's and should be charged accordingly
