bankruptcy?

I'm thinking of filing for bankruptcy, i have 2 accounts that my mother is primary on (car and a credit card). Will my filing affect her?

These are not the only accounts i have, BTW. I have other accounts that have nothing to do with my mother. I am 38, married, and have a 16 year old. I also own my own home, so i'm not moving back home. The accounts that we share are not behind, there are other things, including my mortgage, that are behind

And of course I realize that this is a measure of last resort! It is not something I want to do, but I cant lose my house either. Yes, i've tried to work with creditors, yes i have a budget, there are other circumstances that are personal and not related to question that have lead me to this point. Thanks!

    Yes... It most likely will show up on her credit file and hurt her credit because she is a Co-applicant on the account. That's why these creditors like to have Co's. It puts a bind on both people. It sounds like you are in dire straights. Maybe your mother can refinance these two accounts over to herself without you as a Co and then you could file for Bankruptcy and spare her. She could probably get a personal loan while her credit is still good. NOTE: She must pay these balances off. DO NOT transfer balances from one bank to another. If you do, your name will still be attached and you will have solved nothing. You need to un-attach yourself from her. This is the only thing I can think of. After you get clear of all this you can work on repaying your mother.

    I'm not a lawyer but I'm pretty sure if you file for bankruptcy the house is not a protected asset.

    Is there anyway you can refinance the home or get a line of credit on the value of the home compared to what you have paid off?

    Yes. It will pretty much demolish her credit, unless she gets you legally removed from those accounts for about 30 days before you file.

    Bankruptcy judge should let her reaffirm the debit and remove you from the cards and the debit; or exclude them as your mother isn't filing.

    Sometimes bankruptcy is the only way to retain your residence and start over again. I hope this works out for you, it seems that you aare certainly not alone in your situation.

    Yea, it will ruin her credit and/or stick her with the bill for the things she co-signed. You need to talk with her about the situation you are in and determine with her what is best for the both of you.

    Bancruptcy does not discharge cosigners.
