Can people in common law marraiges file for divorce?

    I don't believe that is necessary. You're not legally married to this person, so there is no need to obtain a divorce. Just you up and leave.

    Common law is only recognized in several states....Isnt it a bit odd that you live with a person for x number of years and without any license or tada you are considered married? No legal documents that say marriage certificate...Maybe after a number of years you can actually get married. With this in mind why would you persue a divorce through the courts????

    Yeah. You file in common law divorce court.

    To be on the safe side you should file for divorce to protect yourself against any law suits filed on your common law spouse.

    Yes, but more and more states aren't even recoginizing common law anymore, and of those that do, you have to have been together before a certain year. Check with your state to see if yours is considered common law.

    you might want to check on your state's law about it. i know that in some states people who are considered common law married are required to divorce just like they were married and are also entitled to anything that a married person would get.
