woman and rape?

IF A WOMAN IS RAPED AND SHE DECIDES TO GIVE BIRTH. AND THE RAPIST IS CAUGHT. DOES HE HAVE TO PAY CHILD SUPPORT? AND DOES HE GET TO HAVE CHILD VISITATION RIGHTS IF HE DOES PAY CHILD SUPPORT? THE DNA FOR HIM IS POSITIVE, THAT THIS IS HIS CHILD. THE RAPIST IS A COMPLETE STRANGER AND THE RAPE WAS A VIOLENT ACT, WITH A HOME INVASION.

    The rapist would have to pay child support.

    In most states, there is no connection between the right to custody and visitation and the obligation to pay child support. You often hear things like, I'm not going to let my ex see my kids because he hasn't paid his child support; but if a person is a fit parent that is not a danger to the child, he generally has a right to see a child even if he doesn't pay child support.

    In this case, a judge would be unlikely to let a violent rapist spend much time with a child, even with supervision.

    Given your facts, I would predict that the rapist will have to pay child support and will have only the most limited visitation rights, if any.

    Interesting! Yes, he can be held liable for child support -- it's his kid. She would have a good case for the courts not allowing visitation rights because he's a violent criminal. Of course if she's making this up and didn't even report the supposed crime, then she doesn't have much of a case against visitation. But why in the world would she choose to bring to term the product of a rape? I don't get it.

    BTW all caps is like yelling. We can hear you just fine in upper and lower case. No need for hystrionics.

    Looking at this situation rationally, I doubt he could pay child support in prison. When he got out.. yeah he most likely would have to pay, and considering that he has raped a woman, I very seriously doubt he gets visitation rights to the child.

    Civil case law from Maryland and Indiana I vaguely remember- judgment for woman medical expenses and support. Maryland had Catholic women who kept child- support order until 18 and property of offender seized, Indiana can't recall if adopted or kept but offender had to pay initial judgment as condition of probation. No visitation until child reached 18 then could decide.

    What state? What city? In San Fransisco he would be voted father of the year In El Paso Tex he would not be around to worry about "he just needed killing" That defense works down here

    I would think this would depend largely on where you live and if there is any precidence in that area.
