the age on a childs rights!!?

does anyone in the state of florida know what age a child has to be to choose which parent she wants to live with? my grandaughter will 10 in march and she lives with her mom. my son pays child support for her. my grandaughter has stated several times that she wishes she could live with her daddy and step mother whom she does love very much! i have heard the child can make the decision at the age of 12 and then ive heard 13. and what does she have to do in order for this to happen? if she chooses this can the judge deny her wish?? this has begun to come up with her in the past couple of months. she wants to live with dad and visit her mom like she has to do now with her dad. every other weekend!! im very curious about this. thank you so much in advance!!

    I live in Indiana, and ten years ago when I was 12 my mom left my dad. Me and my brother both wanted to live with our dad, and the court said that at our age (12 and 13), that they would take that into consideration. I do remember the lawer telling my dad that even if the child is younger, the judge will take what they want into consideration. So assuming that your son is a fit parent (and I don't mean to be rude here, but I'm just saying), and he can provide for her, and can prove that her mother isn't providing well for her, I say there's probably a decent chance. The only problem is (and I rememer the lawer saying this as well) that the judge favors the mother over the father, just because of old sterotypes that it is the mothers job to take care of the child.

    With that being said, my dad didn't win custody of us, the chaces were pretty slim, but my mom finally backed away when she realized it was what me and my brother really wanted.

    I wish your family the best of luck. I know me and my dad are best friends, and I hope your little granddaughter gets to grow up with that as well!

    So when she turns 16 and desires the comfort of her 18 year old lover under her daddy's roof she shall get her wish too? Grandma stop it! Let your son handle his affairs and stop encouraging a wedge to form among the parents, so called adults, in this sordid case. As soon as that little girl realises she can play all you adults as fools, she will.Whoever gives her the desires of heart she want to live with them. A ten year old is not capable, nor any child under 18 to make life altering decision without negative influences from adults self serving only. Mom can't be too bad,she had your granddaughter. Stepmom is probably a schmooser to win over the child from her mom, until she has issues later with her, then what? Its easier as long as child LEAVES for the weekend....remember that!

    13 and wish can be denied...they have to look at each environment, financial status...basically what's best for the child. you should probably talk to an attorny.
