filing taxes claims??

live with my girlfriend for more than 6 months and have a baby together. what way should i file to get more money for us. she had a job for 3 weeks last year didnt make over 500 dollars. and live in texas if that helps. thanks in advance for info.

we have lived together over 2 years now. and shes only had that job. so should i claim her as a dependent too

Update 2:

should i file head of household and 2 dependents?? or just 1? just trying to get the biggest amount of money back for us.

    If your girlfriend did actually live with you for the entire year and you support her (which it sounds like you did because she only made $500) you can claim her and the baby as dependents and you can file as head of household.

    Yes he can file a return for himself. There are several potential problems I can think of: 1. Did you provide more than half of his support? 2. He won't be able to claim an exemption for himself because you claimed him as a dependent 3. If he was a contract laborer he will owe social security self-employment taxes on his net profit of 15.3% 4. Did he receive a 1099 or W-2? If so, the IRS will know about his income. If your friend deducted him on his return and did not give him a 1099 or W-2, your son could be caught in an IRS audit or State workers compensation audit Good luck!

    You can't claim your girlfriend as a dependent, since she didn't live with you ALL year. For an unrelated person, living with you over six months doesn't make any difference.

    Either of you can legally claim the baby, but not both. Since she made so little, and assuming you made more than she did, you should claim the baby as your dependent.
