They are innate to all humans. They were demanded by the anti-Federalist farmers and tradesmen because they feared the Federalist bankers and merchants wouldn't respect them. The latter seemed to want to dominate the states and the people. That's why they sponsored the then-new second constitution (today's) giving the federal government they could control easier than a collection of states new and greater powers than it had under the first constitution. The Federalists initially controlling congress demonstrated that when they passed the Alien and Sedition acts, which blatantly violated the Bill of Rights, a few years later. The anti-Federalist-inspired Democratic-Republican Party under Jefferson immediately repealed those when they took control in 1800.

We.... the Citizens of the United States.
By having a vote to decide who governs us, we in turn are choosing who governs our rights and makes decisions for us. It's what a democracy is all about.
We the people.....it's a finely created government we have, and although it has had problems, it's the best there is!!

No one gives us are rights. They are our rights as being human beings living on this planet.
I guess if you want to get Philosophical the answer would be God or Human Nature or something like that. But no person or government gives us rights... that wouldn't really be freedom!

the natural rights (life, liberty, property) are "given" at birth
the Declaration denies congress and the other gov't people of taking away our natural rights

The "Creator" or God in the Deist sense, Jefferson was a Deist. Not the Christian God.

* The rejection of revealed religion — this was the critical aspect of deism.
* The belief that reason, not faith, leads us to certain basic religious truths — this was the positive or constructive aspect of deism.
Deist authors advocated a combination of both critical and constructive elements in proportions and emphases that varied from author to author.

* Rejection of all religions based on books that claim to contain the revealed word of God.
* Rejection of reports of miracles, prophecies and religious "mysteries".

Constructive elements of deist thought included:
* God exists and created the universe.
* God wants human beings to behave morally.

* In the afterlife, God will reward moral behavior and punish immoral behavior. Although, others believe God wants humans to be moral and affect what they can in their mortal lives, and they will be rewarded in the same life".
However, the Constitution, which gives us our rights, does NOT mention God

Our creator, who is not named. In the deist way of looking at things that means that just by being born, we have certain rights.

When we enter into a government we are granting ourselves the rights allowed by that government. However, if we break a law, we sacrifice our rights.
