What forms are needed...?

to file for legal separation in California?

My mother wants to stop my father from spending unnecessarily until they get into the divorce proceedings. He is buying his new gf gifts and paying her bills with their (mom & dads) share bank account.

Update:

she is looking for an attorney to take care of the divorce at this moment her concern is doing the legal separation and scheduling the court date to have her say in front of a judge.

    Better do it quick - or she should just go ahead and drain the account NOW and go put the money in an an account only in her name in a different bank. Or whatever she considers her part of it. Less his gifts, of course.

    Your Mother needs an attorney and needs to file for a divorce. Have you mother close out the joint account before your Dad spends all the money.

    your attorney should do all of that for you. if your mom can not afford one she can contact legal aid, or any of the legal services in the yellow pages for assistance. for a small fee they will prepare and file the appropriate paperwork for you. please note though, that merely being seperated will not prevent your father from using or hiding his assets.

    she has to go and get forms from the county building (not sure exactly which ones but the clerks there will help). what she really needs to do is move some of the money for now! she has to protect herself before he spends it all!

    she needs to get a lawyer and stop him legally
