Can he sue me for cutting the tree down and win?

Last summer hubby and I decided we wanted to cut a tree down. It lied right down the middle of our yard and the neighbors. Hubby went over and discussed this with the neighbor right before winter hit. They had agreed it was fine. We got ahold of an arborist in February and had the tree cut down. Our neighbor even showed up in the middle of it being cut down, and even chatted with a few of the workers for a few minutes. He then left and went back to work. Never stating any disapproval of the tree being removed. Now he is upset it is gone, and is contacting the arborist. Can he sue us?

Anybody can sue anybody for anything. The question is, does he have a case. I think it might make it to court but I don't think he would win. He would have to show malaise and intent on your part. The fact that he not only talked to you, but talked to the contractor who did the job and voiced no opposition, I think he loses.

I don't know your laws, but I would do this:

Look at a calendar and write down the dates of when you discussed this with the neighbour, and everything you remember about what happened during the events.

I believe that you can use such data ib your own defense.

Arborists deal with this sort of thing often, so you could contact another arborist, or your arborist about this.

confident. i think of moving survey markers is against the regulation - verify with your city. He destroyed your private domicile. you will possibly desire to have the flexibility to win. Get some photographs out that have the "formerly".get a surveyor. Does your city have ordinances against eyesores? you will possibly desire to have the flexibility to get a judgment for the timber, and the surveyor. With a neighbor like that, it would desire to be a combat to get them to pay a judgment. The court docket won't deliver together a judgment for you. in the event that they have a activity, you are able to generally circulate after a ingredient of their pay until eventually the judgment is paid.

He can try, but it's unlikely that he will win. Offer to purchase him a new tree that he can plant where ever he likes, as long as it's not on the property border. One more reason why it's really important to GET IT IN WRITING.
