Lady suing us over fake injuries in a car accident, will pictures of her being active help our case?

Okay ill try to make it short. My husband was driving an 02 S10(very small truck) and a lady in an 04 Dodge ram (very Lg. truck) hit her brakes right in front of him. My husband had begun to stop but diddint make it and hit her bumper. It caused only a small bent spot on her bumper, and crupmpled my husbands s10 like a cracker box. I was in our tahoe just in front of him and circled back to the wreck, I was sure to make sure no one needed help, the woman and her husband repeatedly told me they were fine, there was extremely minimal damage to their truck, and they were running around the accident site, they were even picking up pieces of my husbands truck for us. well 4 days later she decides shes got a back injury and slams down an $85,000 lawsuit on us. She has 1 doctor bill on there that is charging us $1200 for massages & $450 in ice packs. well she lives up the road and we always see her running around and living comfortably if we get a video or photo of this will it help us any?

P.S her lawsuit says we have ruined her ability to fuction and ever live a normal life again. Shes even went as far as to sue us because her husbands sex drive has decreased

Thank You all so much I am so confused, there are so many things in that lawsuit that are so staged. Also me and my husband are just struggling working parents trying to raise our sons, $85,000 will bankrupt us, and well loose everything weve worked for. I would think she should understand that being a working mom herself. Im so scared any support helps God Bless You All!

Thing about the insurance is, yes we did have very good insurance, we had uninsured motorist, liability, comp. ...you know the works, however our bodily injury/personal harm limit is 25k so now she wants to get the rest from us.

    I had the same thing happen to me. The wording of the suit is very strange and it probably makes it sound as if your husband was driving recklessly from the backseat, purposely trying to slam into this woman. Its all legal jargon that will be handled through your insurance's lawyers.. You most likely will not have to pay for anything at all. I was sued for $50,000 for each person and the two only got $150 each, which I didn't have to pay.

    Worst part was I already paid for the guys car to get fixed, which I later found out was most likely not even caused by me.

    yes, that could help your case. But back injuries are the only thing that can't be medically proven or disproven. so it's worth a shot good luck...Oh and after the accident if she said anything such as i'm sorry, in the courts eyes that means she admitted to fault in the accident. Be careful with pictures though cuz she could file harrasement charges. If you bring in that and maybe people as charater witnesses it could help

    You need to get a laywer. Then get some video and photographs of her and her husband doing everyday stuff. Show that to your lawyer, and maybe get some other people around the block to write affedavits saying they are fine, or it would help better if you get them to come to court and verify, in person, that the lady and her husband are fine and are trying to rip you off.

    Yes. Technically, if your fiance was not injured in the accident, there is no need to sue. However, if he faced physical injuries, he could sue for any medical procedures, plus time off from work or school. He could also sue for any emotional trauma occurring due to the physical injuries.

    Pictures of her being active, and running around after the accident that she says her abilities were impaired greatly will help you ALOT. So much so that youll be able to countersue for false claims.

    Showing her active will challenge her credibility, and the judge isnt stupid, he/she will start to draw conclusions, and possibly dismiss her claim, and if you decide to countersue for false claims, you might even get some money.

    And wtf, how do you spend $450 in ice packs. The crap is free, your freezer makes it every couple of hours.

    First you need to contact a lawyer to defend the case and to give you professional advice. It is wrong to intrude on other people's privacy so try not to do anything without contacting a professional lawyer to get professional help.

    Yes, it would help in your case but, make sure you have a lawyer to help you with this. Sounds like she's trying to fake a whiplash claim against you.

    Your going to need a lawyer anyway so, start with that.
