i don't know too much about business law... but the sales aspect is governed by the U.C.C. Section 2 (Uniform Commercial Code) and the service aspect is governed by common law...

Strict Liability or an absolute offence means that their is no defence.happens or you do that inadvertently you are liable. mitigating circumstances may be pleaded to reduce the effects of liability or in the case of a criminal action to reduce the penalty
