Repair Shop Negligence... should they repair?

Last November the shop replaced the rear axle seals on my husband's '97 ford ranger 4 cyl, 2 wheel drive. They started leaking again a short time later. They replaced them again free of charge April 07, 2008. On May 06, 2008 while he was driving the differential seized up, making a very very loud growl and grinding noise, almost deafening and he came to an almost sudden stop. My thought is that the repair shop didn't refil the differential fluid(gear oil I think) which lead to it going nearly dry and grinding down the gears. Should the shop be responsible for repairing this? I have gotten estimates and it's going to be about $750 to replace the rear end. Yes the truck is in awesome condition with 75k-85k miles.

Update:

An oil change was done at the same time as the rear axle seal were done, there have been no oil leaks so no reason to check the engine oil. I honestly don't think the average joe checks the differential fluid with engine oil. My dad and brothers are auto mechanics and are shaking their heads with this one.

    You know what, the repair mechanics at the shop where your husband had entrusted the repair of your vehicle must have been under trained to do the right job at the right time. As I see it

    auto mechanics should have a quality check of the repaired part after total replacement had been done. Yes its just right that they do a back job since their work is still covered by a guarantee period. The leak should had been checked and repaired if they/ve done the counter check. Now, the damaged had been great due to their negligence, you can explain this to them.

    Source(s): You can/t instantly sue them for such damage since you have not signed any contract or waiver of any that they be liable for such any causes. Explain to them your disappointment on having to repair your vehicle at their repair shop. I had same dillema before.

    Yes i think it sounds like negligence on their behalf, what about if you were injured because of their negligence, you sound like you were lucky you wasn't hurt.

    I would go and seek legal advice, but to me the work shop should have done there job properly everyone makes mistakes but this one is a bad one.

    SOUNDS LIKE THEY HAVE SOME LIABILITY HERE, BUT IF I WERE THEM I'D ASK WHY YOU DIDN'T CHECK THE OIL LEVEL WHEN YOU CHANGE THE ENGINE OIL. OF COURSE IT WOULD BE NATURAL TO "ASSUME" THAT THEY HAD FILLED IT UP! GOOD LUCK!!

    IF THEY DON'T WANT TO TALK ABOUT IT YOU COULD TAKE THEM TO SMALL CLAIMS COURT!
