Hopefully, he will be charged and put in jail or prison for a long time. He could, however, get out on bail pending trial. There will first be an arraignment where he is told the specific charges in court, and he will be in custody there in cuffs for this if he hasn't been bailed out. If he doesn't plead guilty, there may be a preliminary hearing where you would testify, but it may just be the arresting officer who testifies. The judge would then hold him to answer for the charges and set a trial date. The attorneys would then make motions to discover what information they each have pertaining to the case. You would be called to testify at the trial as the victim. The trial could be either by a judge alone or with a jury (your brother's choice). If he is found guilty, a sentencing date would be set. If he had previous convictions, they would heap that upon him at the sentencing in addition to the new conviction, and would sentence him to up to one year in jail, or if longer than a year's time, to prison (in most states). He would stay there for the length of the sentence or could get out sooner for good time/work time, which would depend upon his behavior in prison. If you are concerned, you should notify the District Attorney's Office that you want to be notified when he is released from prison. You should also go to the civil court and apply for a restraining order, so that if you should see him one night on your doorstep, you will have recourse to have him arrested even though he hasn't made entry into your house.
