I'm just wondering what the general laws are about this...?

I have a friend who lives in Florida who recently found out she is pregnant. She & her boyfriend are not married. She works part time and he is full time, so he is the only one with benefits. My question is, to anyone here that's familiar with these things...in order for all three of them to be covered under his insurance, do they need to be married? She will not be working once the baby is born, leaving him to be the breadwinner. Does it depend on the company? Or is there a state law in effect?

I'm just trying to help her out since she's a little freaked out about it.

Update:

Thanks for the quick replies!

So the baby will be covered no matter what...For how long?

I haven't read the other ersponses so I'm sorry if I'm just repeating someone else. Your friend does not have to marry him. She, however, cannot be covered under his insurance unless they are married. The baby, after birth, is covered for sure. Your friend should look into free or low-cost prenatal care through the state. It is a law that ALL states offer free or low-cost prenatal care for every woman who needs it. I was unaware of this law when I was pregnant with my 1st child. I saw a doctor at 6 weeks and was charged over $1000 in lab/exam fees. I was so frightened of the bills that I did not see a doctor again until I was 26 weeks after I got married and was added to my husband's insurance. My doctor scolded me informing me of the Federal law. I did not know that I could get free prenatal care. Your friend can. She needs to call her local Health Department. The number should be found in the first few pages of her phone book.

In order for her to be covered by his insurance, I am very confident they need to be married. Once the baby is born, the baby can be covered only. This is another benefit of being married, to those who always question the benefits of marriage.

usually she can't get covered unless they're married or been living together for 5 or more years and can prove it, but getting married now wouldn't exacly help because the pregnancy would be a pre-existing condition and wouldnt cover her. but the baby gets covered 100% regardless if they're married or not. kinda sux i know but there are a lot of county programs that can help her out or even planned parenthood help mothers with no insurance for pretty cheap. even if she might be ashamed asking for government help try to convince her to unless she wants to get into debt really bad. delivering a baby in the hospital alone is about 10k without insurance without state/county help.

EDIT:: the baby will be covered til he/she is 23 years old as long as they're a full time student, if he/she doesnt go to college then til he/she is 18 or if the baby gets married before that then insurance stops but that's not until 18+ years into the future

Only the baby can be covered..If she wants to be covered she needs to marry him...or she can apply to the state for medicaid...it is a really good thing to do...she is covered through the unborn child and for 6 months after the baby is born..If she is not working and they are not married, she can easily get this through the state...tell her to call health and human services.

most insurance companies will require them to b married for the gf to b covered on the insurance...but the baby can b covered once its born since it is his baby...

she might want to apply for the medical card and c if they will help until the baby's born...

i would still check with his insurance company to make sure tho...

It does go by what company he is working for. The same thing happened to me. My fiancee can't put me on his insurance until we are married.
