This question I am posting for a Spanish person. He has a niece that was born in the U.S.A. about 16 years?

ago. Her parents were here without permission. They all left back to Mexico when the child was 1 or 2 years old. Now the daughter who is 16 years old wants to return to the U.S.A. The uncle wants to help her get back here. What is it that he has to do? I did tell him that if her birth certificate said born in the U.S.A. she was a citizen. But please, can you elaborate more, and I will translate for him. I will be marking the best answer. Thank you so much for any help you can give them.......blessed be....bori

    It all depends if she has a birth certificate of USA that means she's an American citizen. She can ask for help in the US embassy which in Mexico is in Reforma Ave near Sheraton Hotel. That person can also ask for information in Relaciones Exteriores. The problem would be that the child was not registered as American but as Mexican.

    You know? I have a co-worker whose child was born in Canada and she's a Canadian citizen even though she lives here (Mexico). Now she has both nationalities. Good luck with your friend. If he needs any help my mail is open. God bless you friend.

    Most of these people have absolutely no idea what they are talking about. If the child was born in the USA then the child is a US citizen. Period. The child has the absolute right to return, live and work in the United States. Period.

    The child and her parents should go to the closest US consulate, or the US embassy, in Mexico. They need to speak with a US consular officer. Take the US birth certificate and any other Mexican ID the child has. The parents should take their Mexican ID's, marriage certificate and any/all evidence of their having lived in the United States.

    It should be very easy for the child to obtain a US passport. With that she can return to the United States at any time.

    it is going to be hard to prove that the birth certificate in question is actually hers. and then if the parents registered her birth upon arriving in mexico with the mexican civil authorities it will complicate the matter. the parents will need to prove they were in the u.s. at the time of the birth, try to get any pre or post natal care records that would have the parents info, address at the time, rental receipts, employment verification, the more you can document the better to prove her claim. if she was in fact born here she does not lose her citizenship just because her parents took her to mexico to live. all will have to be presented to the american consulate in mexico in the attempt to get her u.s. passport.

    if she does not have a birth certificate,then you will have a problem getting it because of certain restrictions on obtaining birth certifcates. contact for more info if you would like.

    I don't see what the problem is. If she was born here, that makes her a us citizen!

    She has to get a passport and obviously is able because she is a us Citizen. The parents filled out the paperwork in the hospital and applied for a birth certificate.What's the problem?

    its not easy but its not an impossible task, when she was born a record was created ie birth certificate, even if she dosent have it with her, she can ask for one to the state where she was born, most of them have websites in Spanish so that should be easy, once obtained she can go to one of the US consulates in Mexico and ask for a passport, because she is a minor she will need her parents consent in order to get it but that again shouldnt be an issue. once thats settle then she is good to go.

    If she does not have a copy of her birth certificate she can request one from the Vital Statistics Office in the state and county she was born.

    just because she was born here by illegals , doesn't mean she is a citizen. The US passed laws that if the parents are here illegally, the child does not get instant statues. Why would the government reward illegals for coming by granting their child citizenship? You better contact the consulate, this is not going to be easy.

    It will not be that easy. If her parents declared her a Mexican citizen when she was going to school in Mexico, she would have to present to the American consulate that she was born in the US and that she still remains as an American citizen. If the original birth certificate is still in her possession she can go to an immigration judge and declare American citizenship. It is not as easy as it looks.
