Seatbelt ticket - policeman's word against mine.?

I just received a ticket for not wearing a seatbelt. But I was. and it looks like it's a police officers word against mine.

Now i have the frustrating decision of whether to just accept this as bad luck or go to the magistrates court and risk court costs , time , disruption to my business while i focus on this.

The circumstances are :

One traffic cop was holding a hand held speed camera, and the other walked out in front of my car while he flagged another car down for speeding.

In my right hand i was holding a phone which was not connected.

The officer flagging down the car was then positioned by the right hand corner of my slowing car.

As I altered the direction of the car to be a safe distance from the officer, who was in the middle of the road, i turned my right shoulder and arm [ holding the phone ] and replaced it in the central aisle. It looked to the cop as if i was refixing my seatbelt.

The officer with the speed camera issued the ticket.

What to do?

    Oh, quit whining and pay the fine. If you go to court you'll pay court costs, plus the cops time, and that $75 seat belt fine is going to look pretty cheap.

    Why is it that when someone does a narrative for a ticket they're all detail oriented, but apparently not when the cop asked them about it at the scene??

    Depending on the state, some states require you install seatbelts if your car is not registered as a historical car. Some states don't require you to get them at all, but the Police will still write you the ticket, then you have to go Court and fight it and then you end up paying Court fees. The easiest thing to do is find out what your state requires, then carry a copy of said law in your car so you can show the officer. I have a friend with a diesel truck that is over weight and doesn't require an inspection sticker, but she still gets pulled over all the time and kept getting tickets until she printed out the law and started showing it to police when they pulled her over.

    You didn't say how much the fine was for? You have to compare that with the court costs. Also, how do you go about proving that the police officer was wrong? The court will take the officer's word over your word if you can't prove that the officer is wrong.

    it shouldn't cost you anything to fight the ticket except for time off work. If the police officer shows you may end up having to pay the ticket. Their word usually wins. But they usually hold those court dates on the officers' days off work and they commonly no show. When they no show you automatically win. If they do show you can just hope your story wins. I don't think you have much to lose to fight it. Except I think you have to take the points if you fight instead of the traffic school option which probably isn't that big of a deal.

    You need Legal advice - common sense says that you should fight this all the way as you did nothing wrong - the reality is how much will the fine be and how many points will you lose if you plead guilty or how much will you lose by going to court in terms of loss of business.

    What ever you decide it will be the right decision for you !

    Do not go gently into that good wallet -- rage, rage against ... -- with a nod to Dylan Thomas.

    Send a brief note including date, time, location when ticket was issued, explaining the facts as you have here. No municipal authority has time to fight a fighter. You'll probably win IF there is nothing you've omitted here.

    I tried fighting something similar, a cop's word against mine - he was not mistaken like yours, he was lying. I wish I'd just paid the g0ddamn fine instead of thinking justice would prevail - got six points on my license and fine :( Just pay the fine and walk away, that's my advice - good luck :D
