Is it illegal for an employer in Illinois not to pay you if...?

you still have a large draw on a "draw against commission" plan. Say a small business has been really slow for 5 months so an employee has just been pulling from their draw so they owe $4000 to draw. Then the owner decides to sell the business and the new owner doesn't purchase the draws. Is it legal for the old owner not to pay you for 2 weeks (50 hours) of work since he claims you owe money to him?

    If I'm understanding you correctly, you basically borrowed money against your future earnings, correct? If so, yeah, they can absolutely not pay you until that is repaid, unless you have an employment contract stating otherwise. Old or new owner, doesn't matter, the you owe the money to the business and the old owner can garnish your wage for that amount.
