Where can I file a complaint?

In late March I was let go from my job. I had been put on a preformance inprovement plan for a period of a month but was released before being allowed to finish even though I had shown improvement. I was working in a sales driven environment so your aware, these were common when numbers dipped. I honestly think the aburptness came about because my boss somehow found out I was seeking other employment (well duh). All that part doesnt bother me, I can handle that with an eye roll and move on.

The part that bothered me came when I was seeking a new job and I found out my boss was bad mouthing me and making untrue claims like I had attendence issues when I was never counseled on attendence. I dont really want to pursue a lawsuit just scare him a little bit so that he stops hurting my chances of gaining employment. I heard you can file a complaint that will notify the employer but I dont know where or how.

    If it is put into writing and sent to prospective employer it is Libel. If it is spoken it is slander. You need to consult a Lawyer. You can try the BBB but you will not be well received. GL.

    Unfortunately very, very, very few states have laws against a former employer bad mouthing you and I would bet you are in one of those states (California being one of the few who have laws on the books about this.) I have a friend who recently went through exactly what you are going through and she hired an attorney to scare the hell out of them (We are in NYC.) The attorney first contacted them by phone he was representing her and was calling to ensure she would not be blacklisted (given a bad recommendation) or legal action would be pursued. He then followed up with a letter. If I recall correctly she paid like $850.00 for this service, but she got a job soon after. There are no agencies you can complain to regarding this. I'm sorry. Wish I had better news for you.

    Go to your phone book and/or Yellow Pages on the computer and call your local (usually county) bar association. Ask them if they have an "Attorney Referral Service" and/or ask them for names of attorneys that do employment law for employEEs.

    When you call the law office(s), speak to the ATTORNEY about payment - ask them if they will accept payments - most will, if they know about it beforehand.
