Tenants rights regarding getting a pet when lease states no pets?

My rental agreement states no pets but over a year ago my on site manager gave me permission to get a cat. For a year now the rental company has accepted my rent. However the old manager left but a tenant already living there took the job. Who also happens to have a dog along with several other temnants. Last week one tenant complained about another tenant having a cat and we were all given notice to get rid of our animals. 3 day notice. The management company said they dont care what old manager said the pets go. Can they enforce this even though they continued accepting my rent for a year and the new manager knew I had a cat?

    I wouldn't give up the cat if I were you. Just because it's a new manager doesn't mean you should give up the cat you had permission for. And whoever the tenant is that complained about the cat should be *censored*. I don't think they can legally take the cats away from you or do any of that stuff though. If I were you, I'd call up a lawyer ASAP. If you're allowed to have kids at this complex, there is no reason why you can't have pets. Kids are messy, smelly and cause damage too, more so then a cat.

    What if you and the other cat owners threatened to go and take your cats with you to other quarters? Would they want to lose that many renters at once? Sometimes a threat is all it takes for them to reconsider their actions, particularly if they had allowed you to have your kitty for all that time.

    2) Ask for a change in lease terms allowing cats if you are willing to pay a small "recleaning fee" upon leaving...say $50 or so. This meets management half way.

    But in answer to your question, the actions of the management can not change the terms of the written lease. They can require you to give up the cat or throw you both out.

    Your California lease controls your rights. You have no implied rights to have a pet, except if you can prove you need a service animal/dog (i.e. seeing eye dog, dog for hearing impaired or a dog that provides and fulfills a physical need) This would require showing a doctors letter and proof that the animal is trained to provide such services. I have seen monkeys trained to help people Upon lease renewal, you might threaten to leave if you are going to be continued to be denied a pet. Have you tried to negotiate? Unless you seek to have a companion Doberman, Bull Terrier, Rhodesian Ridgeback, Pit Bull, Akita (dogs not known as being generally sociable) you might be able to convince your landlord that upon payment of a reasonable pet deposit you should be allowed to keep (1) dog.     I'll try to make this quick but if you are in Canada a law was passed they can not discriminate against people with pets.I would not get rid of my little buddy. I would tell them you are making plans to move and do it they cannot throw you out overnight. You can always find another place to live you can't replace your buddy and do you nreally want to stay ther if you can't keep your pal. They are being bullies thinking if they push you pet owners will cave. Talk to other pet owners in the building I'm sure they feel the same way you do. I would move rather than part with my buddy and they will have a lot of vaccancies or unhappy tenant just try to keep one tenant happy.

    It comes down to the lease you signed. Even though the old manager "turned his head" in regards to pets, the new management company has the right to enforce the lease as signed. It's too bad the animal hater had to ruin the status quo for all others.

    If your lease says no pets and you do not have a written amendment then they have every right to enforce the lease. You might ask if they would consider accepting a deposit and amending your lease so you can keep the cat.

    You should try to reason with them. If you do not have anything in writing saying that you are legally allowed to have a pet but they do have something saying you are legally not allowed to have one, most likely you are going to have to get rid of it.

    If the lease says "no pets", then that's what the judge would go by.

    unless you had your lease ammended in writing...........I think you're out of luck
