From what you say here, it appears that he was deported. How long is his ban? 5 years? 10? It will be quite a few years (until after his ban is completed) before you can apply for a spousal visa for him. But if you don't live together meanwhile, it becomes very difficult to prove a valid marriage. It will be expensive. And you will have to prove you have sufficient income and assets to support him and guarantee a $30,000 bond.

He can apply for you to immigrate to his country as his wife. Then after the ban is lifted, you can apply for the spousal visa, and it will only take a couple of years to approve it, if you can support him.

You need to file an I-130 petition for him.

But if he was here illegal for more than 180 days he is subject to what they call the 10 year bar.

He can file a waiver (I-601) along with a lot of supporting documents and some sort of explanation, but he needs to show that the US citizen will suffer EXTREME hardship. This may or may not be approved.. This are very difficult to get approved and you will most likely need an attorney. This is the part that is expensive.

If he had some sort of visa or permit to be here, then it will be a breeze.

    Good luck

Was he deported or did he agree to leave on his own?

    Did he receive a ban?

    Are you a citizen?

Now that he has left the country, you can apply for a visa for him if you are an American citizen.
