What is the penalty for a 3rd DUI?
My father just got his third DUI. His first was 18 years ago, 2nd was 4 years ago, and this one was Sunday night.We live in IL, but what does anyone know about anything that will possibly happen to him?

It ain't good. Your father needs serious help and a good lawyer. Here is what I found:
# Third conviction (Aggravated DUI) — Class 2 felony with possible 3-7 years imprisonment; mandatory minimum 10 days in jail or 480 hours community service; fines of up to $25,000; loss of driving privileges for minimum 10 years.
* Within five years of previous conviction: Mandatory minimum 10 days in jail or 480 hours community service (terms of imprisonment or community service not subject to suspension/reduction nor is offender eligible for probation); eligible for RDP after one year of revocation; required to have a BAIID installed in vehicle as part of driving relief.

Varies from state to state. Most states have a 10 year look back period...like California does. His 1st was so long ago, it will probably be considered his 2nd. Maybe a small amount of jail time, maybe not. Maybe house arrest for 30 to 90 days, maybe community service, loss of license for a time, insurance increase possibility, a fine. People try and scare you with the maximum penalty jive, but rarely is it imposed unless someone has been killed or something of that nature.

In my state, it's an automatic 2 years in prison.
