Would this be a copyright infringement?
I drew these pictures and wrote a story with it and I am thinking about sending it to someone to make it a cartoon. The problem is one of the main characters might be a copyright infringement. This character is name Bob the Tomato and is a tomato and the main veggie tales (popular child video) character is named Bob the Tomato and is in fact a tomato. Although these characters have the same names my bob the tomato is going to not act or be like the other bob the tomato. So is this a copyright infringement?

If you are thinking of any form of distribution or publication then you will need to be very careful or it could prove to be a very costly mistake. Either change it or take legal advice.

If you're not publishing the cartoon, it's no problem. But why not just change Bob the Tomato? That doesn't seem like it would be hard to do.

I'm pretty sure it would be if you ever used yours publicly or commercially - the name and likeness is a problem no matter how he acts. Consider just calling him Ollie the Orange or something and avoiding the hassle.

I would say yes. Turn your character into a carrot instead. (unless he's in veggie tales - avoid all characters in veggie tales)
