Child support and child care payments question.?

My child support payments include childcare (daycare) payments. He has been out of daycare for about 5-6 years. Should I still be paying for this?

    No, you shouldn't. You might be responsible if he has a babysitter on a regular basis (after school).

    Consult with a divorce/custody lawyer to find out if it is your best interests to pursue the matter further based on your divorce decree and support order.

    In most states child support is based on a formula based on what each parent makes and the custodial parent has the right to use the child support how they see fit and it is not limited to just child care payment and would be rare for a support order to include such verbiage.

    You could hire a lawyer and see about having the support payments amended based on current income, however, if you are now making much more than you were 6-7 years ago and your ex-spouse making the same or less, it could backfire and you could end up being ordered to pay even more support per week than you are now.

    I would say technically no, but I personally don't think that child support is by any means enough to help out the child (Sorry!). I'm was a single parent for 4 years and struggled like crazy and know that daycares can cost $1000 a month and most support is way under that a month...so, that doesn't include food, clothing, etc. for the kid...so not only is the custodial paying for that but also paying their own bills, (car, house, etc.) Talk to the lawyer though and inquire...you probably won't have to pay that part any longer.

    You can go to court and modify terms of your decree. If you haven't had your child support increased in 5 or 6 years I would say you are VERY lucky and keep your mouth shut. Every 3 years in Texas, it can come up for review. I would do the math and see how it would affect your paycheck before I said anything.

    If the childcare figure made the amount you pay go up, then go in for a modification. If your income has gone up since the order, they could keep the amount you pay the same or raise it. So be careful.

    If this is court ordered you should really go back to court and ask to have this modified. I wouldn't want to be paying for a service that's not even being used. It's not fair to you.

    No you shouldn't, you need to call the local office for child support in your area, not only should you not be paying it, they will probably reimburse it to you. Something very similar happened to us, and we ended getting almost 3thousand dollars for overpayment. Get your money.
