Can I claim for mental agnony and loss of reputation?

Dear All

As usual only advice according Indian legal system.

There is byelaw that the elected office bearers shall serve for 3 years from the time elected.

The opposite group is with majority and so they terminate/suspend. Further they even circulate letter to all the 3000 members. So my question is

1. Can I ask the court for restoration?

2. Can I claim damages like 2laks from the head of the institution and rest a lak from the 10 other committee members who have signed for the resolution to suspend and for sending damaging letters?

3. If so how much will it cost me to file it in the court for the restoration and damages?

    See Captain for any post one gets elected by election in any Society for any executive post of any time duration (3years in your case)which is not for financial gain but sort of social work as in your case can be challenged by the other elected executive members & your post can be suspended after giving you prior notice, hearing your defence & then decided this issue whether you should be suspended or terminated from the post for some genuine reasons by other executive members. What the few executive members did was simply suspended your executive post without following the basic principle of natural justice as I mentioned above. They in revenge took this bold step against you which you can challenge in the court on this ground along with other grounds you have with you. As far defaming you by issuing letters against you that effect your reputation amongst the other members of society too can be challenged & monetary compensation claimed against the signatory to such letter which are defamatory in nature. As far cost in the court is concerned that depend on the lawyer you engage on lump sum basis or date to date hearing basis.
